Hi everyone,

I just had an accident, my whole rear bumper (the m5 bumper 2months old) total lost and the exhaust tip of my new esienmann quad exhaust (2months old) are bend and i think my shock also got problem.. A taxi crush onto my rear when i stopped at the traffic light along bukti timah road. He ask me to claim his insurance.

Want to ask you guys if i am able to claim back a new m5 rear bumper or got to claim back the orginal 5 series bumper and also my exhaust will i be able to claim back esienmann or must be the orginal exhaust ... Please help bcoz first time people hit me.. Heart very pain and somemore its coming CNY..

aiyo...so sad..M5 bumper and esienmann pipes..ahhhh..heart pain!! one of the top things that fits a E60..all smashed..

Bro,

Sorry to hear about your accident.

The objective of insurance is to reinstate your property back to the condition it was in before your accident/loss. So you should be able to claim a new M5 rear bumper and Eisenmann exhaust - but try to confirm this with the surveyor sent by the taxi's insurer first if possible. If the taxi is insured by NTUC, you have to send your car to IDAC for inspection.

If you haven't already done so, take photos of the damage to your car as proof. If there are any witnesses (your passengers, the taxi's passengers, other motorists or bystanders) and you have statements from them, then you have a rock solid case that you were stationary when the taxi hit you. If not, it should still be pretty clear-cut from the damage to both vehicles. But any statements you have will come in handy in case the taxi driver decides to give another version of the accident instead.

If the taxi insurer doesn't say that it will pay for the repairs to your car, claim against your own policy first to get the repairs done, then claim against the taxi insurer later.

Even when you manage to claim from the taxi insurer, they may deduct a bit from whatever amounts they offer for your M5 bumper and Eisenmann exhaust as depreciation for the 2 months you've had it. If you have receipts from when you bought them, keep the receipts as you may need to prove that they really are 2 months old only.

I am not trying to play the devil's advocate here, but will aftermarket mods subjected to claims?

Say you paid $40K on ICE, and the cab smashed your entire trunk and the subs and amps. Can you claim the damages? I was given the impression that only stock parts are claim-able (unless parts are assembled at agent's level, example ACS kit and rims at PML when car is delivered)..... but it is best to check with the agents.......

Should be able to tell from the damage. my whole rear is gone and yet the taxi front bumper only dent inwards.. damn taxi driver.

Shit, heart is sinking now... I just got it all done up ready for CNY.. Will do a check tomorrow..

But if its claim against another party, I believe it will have to reinstate whatever part they damage.

but i agree with ken.

got hit by a f**king 13-tonner before and all i could claim back was stock parts.
and PML absorbed 20% of the claims.
which means i could only claim back 80% of all the repair fees. nabey.

Satines is correct. If your aftermarket mods are not listed in your insurance policy, then you can't claim them from your own insurer as you didn't pay a higher premium to cover them (assuming they can be covered in the first place). The scope of your own insurance is limited by what you paid for.

However, this doesn't apply to the insurer of another car which bangs into you. That insurer has to make good your car to the condition that it was in before their client (in this case, the taxi) banged into you. There is no limit to third party insurance from what I can remember of my time doing general insurance claims.

Did you claim against the 13-tonner's insurer yourself?

Thanks so much for all the advice... Once my car is back, will go for the meet -up and buy you guys coffee.. Anyway i've never been to any meet up yet.. dunno anyone

Just spoke to an insurance friend. He gave the following insights......

All cars are insured based on stock condition. So what you paid as premium only covers stock parts, if you are claiming your own policy, at the peril of your own premium. This part is intuitive.

With the exception of NTUC (who uses IDAC for assessment), all insurance companies now have their list of affiliated workshops, which will conduct their own due diligence on behalf of the insurance companies. So put simply, if you are claiming against the taxi's insurance policy, the company covering the taxi will survey your damages - you will be at their mercy, whether they allow after-market parts to be replaced. This, according to him, can be very tricky, especially when some of the parts are not known to the company. ICE falls into this category.

So, back to the drawing board - only your insurance agent could only do a guesstimate if these parts can be claimed. Obviously, if the variance is not huge, no alarm bell will be sounded.

Now, there are two issues for you to seek advice from your own agent:

(1) Can these parts be replaced at full costs by the taxi's company?
(2) Will the insurance company find fault with a part that is not LTA compliant?

A kid banged into my car's rear some time back, and cracked/chipped some bits of my Kansai CF diffuser; claimed a new pc against his insurance co. w/o any problem, fyi.

Good luck man... hope your car will be repaired to its original state soon 84K.

Spoke to a surveyor and he said that aftermarket parts are not usually covered but if the price difference is not much, the insurance companies can ignore BUT if the aftermarket part is illegal, like for instance, the eisenmann exhaust, it would not be covered. Heard it from a surveyor a wk ago.

YES! u can claim everything...all aftermarket parts....

SWC does accident claim for alot of modded cars....

as long as u are not claiming againts ur own insurance...u can claim every single aftermarket parts....

those workshop say cannot are simply not experienced enough....

kenn..it can be done..i have a friend who got banged from the rear.. claimed the whole exhaust system ( illegal too ) at full price... plus the aftermarket bumper and aftermarket wheels....

actually depends on the workshop if they want to fight for it.. as long as theres proof on the damage... u can claim everything from the other guy's insurance... but if its ur fault...u can only claim stock aprts...

Where is SWC, i towed my car to yew lip..
