so they booked an apartment and got refund bc of the floor size discrepancy. and now they are suing the developer bc they have lost the chance to buy an EC bc they now exceed the salary requirement. when in the first place they were not eligible bc of the salary requirement.... very creative.

Agents (no offense to some of the bros who work as honest housing agents here) will promise moon, sky, heaven & earth, to make a sale. It's up to the consumer/potential buyer to scrutinize the fine print, so as to ensure adequate protection before signing on the dotted line.

always bring your own measuring tape and calculator when visiting show houses.
you should do your own due diligence.

I'm a real estate salesperson.

The couple likely has no claim against the developer... HDB & Comptroller of housing has changed the rules so each booking comes with something we call the form 3.

In the form 3, exact dimensions of each room, balcony, a/c ledge, kitchen etc are labelled. This includes the void space as well which would have been labelled clearly, together with its size. This is a requirement by law.

For our practise, and i believe that most salespersons abide by it, we get buyers to intial on each page of the form 3 to prevent disputes. Likely the ERA salesperson would have done that too. With their initial on the page, they can't claim ignorance.

In terms of volume of space, the buyer wasn't shortchanged. But the double volume space does not count as double floor area unless they are allowed to build a slab over the double volume space. To a layman, it is just a super high ceiling. I hope the buyer wins the case.

When did the housing rules kicks in ? before or after the case happen? could it because of too much complaints, then the rules came out to protect the layperson ......
