The prosecution has just made it ok for future criminals to cite an affair as a good reason to be left off the hook.

Haha...that's a little too far-fetched. An affair by itself is not criminal but if the affair led you to commit a criminal act, then the affair could be the motive for such "sex-for-favor" cases and the prosecution needs to prove it. Most crimes are criminal in the very act regardless of motives like murder so a criminal cannot just cite an affair to get off the hook. Our justice system would fail if this happens.
