No Drunk Driving but GANTONG 2 yrs ?

Just to share a real life story which happens to my friend recently

One night 2 guys were drinking, 1 sober 1 drunk. The sober guy offer to drive the drunk guy home with drunk's car. While on the way home kanna road block. The sober guy doesnt have a valid driving licence.

Both end up in court , sober guy fine $2000, drunken guy fine $3500 + gantong 2 yrs

WTF ? He didnt drunk driving but kanna gantong......

maybe they charged him under the assumption that he encouraged the driver w/o license to handle his vehicle, given that permission was given. Quite harsh.

next time this situation ever arises for other friends. just leave the car behind.
Both take taxi.

Will this be classified under those cases where you ride shotgun with someone who doesn't have a driving license? Got drink driving charges?

IMO no offense to OP

i sensed the account of the story might not be 100% of the truth..
on what basis TP can charge a drunk who is not on the wheel of a vehicle? he got fine and suspension due to allowing illegal driver to drive his car..?
may be there is something more complex behind the incidence..

+1... do not think there is a basis to charge the drunk guy if he is sitting in the passenger seat or back seat.... could have been more behind the story.....

the sober guy that drove without a valid driving licence should be penalized haevier.

from i can remember from the theory stage - a drunk can still be charged if he is caught in his car even without driving (he can be sleeping, resting or doing nothing) cos theres possible intention of him driving ={

Ok, if I nv remember wrongly, I remember reading somewhere that if you hold a valid driving license and you let a person with no valid driving license drive and you are a passenger in the car, your valid driving license will be revoked, this is independant whether the person with the valid driving license and is a passenger in the car is drunk anot.

he gantong becos he allow someone w/o driving licence to drive his car.

When he last spoke to the police, he said that he didnt know that his friend doesnt have valid license, hence he was serve the gantong.

He can take a personal suit against his friend for not informing him that he doesnt have a valid license and drove his car, but the gantong still stay

so it appears that the title of the thread is misleading. State of drunkeness or soberness has nothing to do with the issue.

just wondering.....if he did not give permission / allow his friend to drive, what is the outcome.
