Man who punched and fractured gangster's jaw escapes jail

SINGAPORE - A Singaporean businessman was fined $3,000 on Thursday for punching and fracturing a gangster's jaw.

The Straits Times reported that he was spared a jail sentence as the judge said it was an exceptional case.

Ong Long Hock, 64, had pleaded guilty to causing hurt to Lee Tze Wei, 32, a sales executive.

The incidentoccurred on Feb 17, 2009 at about 7pm. Ong and his family had drove down to the Punggol Nasi Lemakstall near Tanjong Katong Road.

Ong's daughter-in-law, Delia Chiang Chia Yen, 31, was on the way toqueue for food when she was pestered byLee and his friend.

Claiming to be gangsters, the duo swore at her and her husband. The two men started punching and kicking Ong's son before family members could call the police. A third man also joined in the assault.

Ong tried to break up the fight and was also hit. When the three assailants tried to flee, Ong and his son managed to grab Lee and pin him to the ground. That was when Ong punched him.

"Assaulting him at this point was clearly excessive," said District Judge Toh Yung Cheong, who addedthat the correct thing to do was to wait for the police to arrive.

ButOng's lawyer, Mr A. P.Thirumurthy, said his client was a victim, reportedThe New Paper.

Ong told the Shin Min Daily News on Thursday that he had lost five teeth in the fight, and spent $20,000 on dental treatment.

He said he joined in the fight after seeing his son's bloodied face and daughter-in-law's shouts for help. His son and daughter-in-law reportedly lost a tooth each.

The owner of a printing business is married with five children ranging from 37 to 42 years of age.

He says he wished to put the matter behind them and move on.

Lee has also been charged with causing grievous hurt. His case has yet to be heard.

I hope u did not know (only now) that this is the way our SG Law operates yea :)

When in Self Defence (even with neutral witnesses) and we hurt assiliant, we are chargeable. Chargeable even when helping an innocent and hurting the assiliant... and this is the SG Law.

I would gladly hurt an assiliant while helping an innocent, if get charged and fined, so be it since I can treat the fine as an indirect advertisement for private services on self defence training, LMFAO!

Too bad Mr Ong never learned the art of neutralisation or immobilisation where there's no need to fracture the 'gangster's jaw'.

If the scenario is someone scratched your car, you caught him, he struggled and retaliated with force..........

Options:

~ let him run, call police, knowing that police will advise on civil suit (assuming you have caught that culprit), ended up nothing is done except a police report on possible mischief

~ catch him at all costs, especially with force if he retailates. You might end up like Uncle Ong. Then call the police.

What will you do?

I will do the latter i.e. catch him, if he retaliate, good luck to him as force will be applied..

And as what I had posted earlier, if charged and fined, so be it since I can treat the fine as an indirect advertisement for private services on self defence training, ROFLMFAO!

You will get negative publicity, cause the judge might say......

"Assaulting him at this point was clearly excessive" and that the correct thing to do was to wait for the police to arrive.

option 3, beat him half to death, no need call police

The two men already made known that they are gangsters. Not supposed to use excessive force when dealing with them? The elderly ah pek probably underestimated his fists.

No, then the culprit will call police and you will charged for "clearly excessive" in assaulting him. The judge will say that the correct thing to do was to wait for the police to arrive.

Yeah and as a result you will need to engage the same lawyer.

It is very weird in many "grey" cases..... especially when the law enforcement could not be clear in defining black and white cases.

I will also say, I did not use execessive force nor assault Sir. I chased, caught up, tap his shoulder and call him to stop running... he immediately turned around and swing his arm at me... I avoided the swing while brushing his arm aside, unfortunately because he sway so hard, the brushing causes him to fall face first resulting in some broken teeth, broken nose and abrasions on his face... check with bystander witnesses please Sir, surely you will find that no assault by my action. LOL :dance:

Anyway, if assaulting an assiliant is required to help a victim e.g. old person assaulted by a nabei, I still would.

In US, you can use a gun and shoot at that person as long as you feel your life is endangered. That few gangsters should be glad they are singapore gangsters.

Mr Ong kana fine more than Dr Woffles somemore.. WTF!

if the old man is rich, atas like Woffles....will he be treated differently? and also the same gangster be punished more severely? food for thought

Police while arresting you pin you down with excessive force? I bet they will justify it, while for Mr Ong, they charge him, What LJ law and LJ police force we have.
