If both parties choose not to report to insurance and claim from each other, it is up to either party to ensure they have taken measures to recover the damages. From an insurance company point of view, all accidents, however, minor must be reported to them to avoid a situation where one party change their minds later and make a claim. From the police perspective, it's purely civil unless there are injuries or deaths. The best way to recover the damages is to collect money on the spot. If you arrange to recover later, the other party will often change their minds about their liability. In addition, it is a must to snap pictures of the accident focusing on the damaged areas even if you are the one admitting liability to avoid instances where the claimant try to pin other damaged parts on you. NRIC numbers and addresses must be exchanged. The moment the other party refuse to accede to any of these, take pictures and report to insurance. Otherwise you end up with a situation like this where you cannot recover anything and there is nothing you can do.

Fender-benders like this are considered civil cases where the police will not get involved. I don't know how extensive is your damage but you may want to report to your insurance company. If her insurance company lodged a claim against yours, you will be at a disadvantage. And it's worse if she puts the blame on you and claim other "injuries" like whiplash that is hard to disprove. Then you will be put in a defensive position. Hopefully you have taken pictures of the damages of both cars. Just my opinion.

Lesson learnt .... Police does not do anything for you especially in civil cases.

Unless you report a criminal case like hit & run.

next time, remember the car plate number and get a doctor report saying your neck pain,head pain etc and go to the nearest NPP and report.

On this topic, I remember a forummer here who kenna banged by taxi and he called police, ambulance, fire engine, Army and probably Air force, to come to the scene of the accident cos he said taxi drivers cannot be trusted and you need as many witnesses as possible and make it so big the taxi driver wun luan soot say ur car rolled backwards on highway and hit him.

As I grow older, I realised that my high-tech handphone is not just for taking food photos or expensive restaurant photos/check-ins to post on Facebook to impress my friends.

I could have taken photos of:

- the driving licence of the driver if there is a claim of no NRIC
- the license plate, the road tax disc
- the damages

I could have video/taped down the conversation of the driver at fault.

Just something I learnt what my phone can do.

Tell the police that you dont care whatever they care or not and want to lodge a police report for record / future civil claim purpose. if they mati mati dont wanna lodge a report for you, get their ID number and call 999 infront of them to lodge a complaint.

U can lodge a report as confirmed with a staff sergeant at police post. But it is a report but nothing to do with accident

Iirc, A report is a must before you can loadge a magistrate complain at the sub court. With that, the magistrate will direct(order) the police to find the owner of the car, you will need to engage a lawyer to serve a summon to the owner and proceed with your civil suit.

Hi bros,

Jus an update again...I went to TP today to lodge a report...they were surprised and the staff there went to another room to check with his immediate on what to do...I waited for another 10 minutes and he came back telling me to report to GIA. They say they would not do anything unless there are injuries or property damage. But the most that they can do is to take note of the vehicle number.

I know I might sound dumb to let the lady driver to chose her option even though I am the victim but I am just trying to be more gracious (follow what the government want us to be mahh)...but if the other other party wanna Mayan me then I think "gracious" would not be an option for me...

Anyway it's not a superb serious accident, I think the lady driver do not need to be on a hide-out for such a matter...I had hit on others' vehicle on the road before...I also quickly came out to apologise and offer the repair...if wanna drive, accidents are unavoidable.
