Damage to personal property NOT necessarily punishable under penal code.

If someone scratches your car, it is NOT vandalism, but MISCHIEF.

Isn't kicking the car a natural reaction to the rude shock created by the car? Since there is no intention, no mischief.

Call police. Police will tell both party to settle themselves.

Still back to my original question - who dares to call police first?

My opinion : car owner report police first bah, car owner shld or got give way or not only they themselves know unless got witness. Even nvr give way also the most kena warning by police. If car kena kick and got dent, got evidence. I think the one who lay the hand first suffers. In this case, the one who kick the car suffers more.

"You failed to stop when I wanna cross, and my reaction was to kick your car "away"...... you can sue me privately but Mr Policeman, can you issue him a ticket for the following:

1.Failing to give way to pedestrian at pedestrian crossing.
2.Unable to stop your vehicle before reaching a pedestrian crossing.

He almost killed me, Sir !!!:

6 points !!! Ding Ding !!!

You obviously have not kenna before.

Even if you caught someone INTENTIONALLY scratches your car, do NOT expect a charge of vandalism.

Typical response - we will take note, meanwhile you can sue the culprit.

At most, it is a charge of mischief.

Don't believe me? Ask any police officer.

Re: Who is right of way?

I'm always amused when someone puts so much faith in the police.

Im comparing between the 2 who will suffers more. One kena sue by lawyer for damage and the other by the police who issued a warning or ticket.

You are assuming the car owner will SUCCESSFULLY win the suit.

Let's be honest, if TP awards a ticket to him, who you think the judge will rule in favour?

"Your honour, he didn't stop, almost killed me !!! My first response was to kick the car "away."

Haha I think the judge will punish the 2 persons. Issue the ticket to the driver and kicker to bear the damage cost :yummie:

Re: Who is right of way?

I think this all boils down to patience. I must admit that Im a reckless and impatient civic driver when Im in my early twenties. I believes patience grows with age (unfortunately not all). Now Im in my mid thirties, still impatience at times but will consciously remind myself to be patient before I reach for the high beam/horn. : )

Re: Who is right of way?

Mayb i shld kick the car and pretend to fall down. Make sure i got witness. If the driver not apologetic thn call ma ta lor..
