Man, ADs are up in the ass all the time about the problems which come with the cars they sell. It's crazy to think your biggest headache would be your dealer not being able to find the problem or saying it's normal vehicle operation, instead of the trouble or annoyance the problem gives on it's own.

Sometimes PML staff are just plain lazy or incompetent.
On the other hand some customers are just plain a$$h@/e5.
So must look at each case to see who is right or wrong.
But go to court, I think unnecessary la. The most sell car loh, the loss still lesser than lawyers fees+ time + unhappiness, tio boh?

In my opinion, sometimes it is not about the money, but the principle. Many of us have had horrible experiences, and some may have had suffered greatly, not just in terms of car-related losses but to life in general (loss of face to clients, friends, 'nieces', etc) that the inconvenience and distress is no longer measurable in monetary terms. Could you imagine parking somewhere to run lion and halfway the car breaks down... coitus interruptus at its best.

Now, what we as consumers expect is a human touch in the very least. Often a simple "sorry" could have done the trick. It is just that some entities adamantly refuse to admit that they were wrong right till the end (sounds familiar?). In this regard, even if upholding the principle and setting the record straight costs a Senior or QC and hefty court fees, some may still feel it is worth it.

Most consumers will be on his side. Wah lau, so many months and things replaced. For goodwill alone, PML should have just given him a new car. Now kena bad publicity.

Court will decide what % of the lawyer fee will be borne by PML .

Questions:

(1) If, and only if, the driver wins, and PML is asked to pay for damages, will it trigger more lawsuits?
(2) In either case, will PML buck up?
(3) Will PML design a new sales contract to cover what's considered "defects" and what's wear and tear?

by definition, the phrases "defect" and "wear & tear" cannot be defined in the strict sense because much depends on the facts of each individual case and also how the "experts" see it.

For eg: U abuse the gear shift, everyday F&F, change the gear like u are an F1 driver... and then your gearbox spoil. U go in and admit u F&F the gear everyday or claim there's a defect? AD workshop will examine and say ..wahhh seems the gear went thru some stresses...its a wear & tear thing...cannot claim.

Then owner say BMW what! Gearbox shd be able to handle such stresses cos its a BMW and that's why u have that sport+ mode.

AD will say..yes but within certain tolerances and also "in accordance with normal usage".

Issue then turns on what is "in accordance with normal usage"

yeah ... so far i have not seen AD lose to consumer
with all the iron clad terms and conditions ... consumer to win is 0.0000001%
besides, AD did put in "effort" to resolve the issues even though the car is in the workshop for 10 months ... :lol:

not long ago there was a news on Rolls Royce owner sue the AD about "noise issue"? what was the verdict?
