better to claim own insurance and work out the loss of NCB and get compensated by the other person
If he disagrees, then proceed with a civil suit?

LTA lah. It is based on the valid road tax disc.

The regulator for insurance industry is MAS. The question has more validity in that sense as compared to LTA.

MA losing their touch... business must be good. I went to them for a quote for M-sport bumpers, asked for a discount (because it came out REALLY expensive) and 1 week later... boh reply despite sending SMS reminder to my SA. (FYI my SA replies promptly to SMS most of the time.)

Actually to thread starter, why don't you just ask an outside workshop, and just claim that amount from the person (cash). Then just go and repair it. If you want MA to repair, you top up the diff... at least not so xiong.

Thanks all. The Malaysian person actually called me up and he was really pro-active in wanting to help me. So I have the documentation required now to do a Third-party claim at a workshop in Sin Ming willing to take-on such case.

The Malaysian actually suggest me to repair my car at PML or Munich so that I get a proper repair job. He also owns a BMW and he told me that he is fine with the 5k plus bill since he is claiming insurance anyway.

So now, should I proceed 3rd party claim or repair at PML/Munich and wait for my insurer to file claim process? My NCD willl be removed till the claim process is finalised.

my m sport front bumper cost only $1.2k to replace.(at that time, except PML, whole singapore only got one.)
your rear bumper cost $5.6 k ?
you want me to give your my workshop name ?

Legal recourse as only a last resort and since the potential defendant is a singapore citizen,
compensation & cost are best address locally since the accident happened here
and not in KL with a Malaysian driver in a Malaysian registered vehicle

i recommend getting a 2nd opinion elsewhere and asking msian guy to pay cash for that.

That guy damn steady, if I were you, I will buy him a beer. I think M'sia insurance not as fcuked up as SG. They treat insurance as what it is --- to cover you when you need it most. Here, our insurance companies won't hesitate to kill you after a claim. My mum for example had her premiums shoot up from $1k+ to $6k+ when she had a claim of $8k+. That's why we're so damn scared, and that's why workshops anyhow chop.

HEY WHERE'S OUR "CHECK AND BALANCE" AND "SECOND VOICE" WHEN WE NEEDED IT.

I would say of its really a super pain in the ass for u to go thru PML or MA cos of NCD & all, then just go to a reliable workshop & do it & get him to foot the bill. They are workshops specializing in conti cars repair with gd paint jobs. It's already very fortunate he is willing to be responsible. 5-6k difficult to swallow for him so surely it's by insurance. 2k should be reasonable for him to pay in cash. Even if you were to take 2k & top up to repair at PML/MA, the amount paid on topup is still cheaper than if your future premium escalates!

Outside workshop can do just as good or almost as good bro, life is short, COE is shortest, don't stress over it. No one can truly spot the difference if u repair at PML/MA or a really good quality workshop.

Get a quote then get money from Malaysian driver then repair.

Let me breakdown the MA quote:

Replace front bumper panel: S$198
Front right PDC sensor: S$288
Painting bumper: S$1,300
B021321 panel (dont know what the hack is this): S$984.30
Replacing right headlight: S$132 + 1,933.55

Not including labor and misc charges

On the contrary, i think their biz is bad le. They juz sent me a pamplet for servicing with free BMW air refreshener.

But..............

I am driving Japanese lifestyle car le.

CANNOT.

There was a case in 2009 on this very issue (imagine that..2009 and now 2013 still NO IMPROVEMENT!)..

In that case..The High Court in Singapore presided by Justice Kan Ting Chiu, ruled in a judgment that the relevant Singapore law for third-party risks and claims applies only to insurers of Singapore-registered vehicles for collisions on roads here.Similarly, a road accident victim who seeks damages in a Malaysian court for an accident caused by a Malaysian vehicle in Singapore will also not be able to sue the Malaysian insurer in a Malaysian court for the same reasons.
This means that accident victims can pursue the claim against only the offending motorist, and not against the latter's insurer.

So yes.. LPPL

On advice, I have reached out to SWC (Mike) for quote but in any case he does not do third party claim also.
