Serious question - how to reply a buyer.

If u sell ur car & the buyer came back after one month & demand u need change the brake rotors cos I was the one used it? How to reply him?

Firstly before the car is sold;
1. A STA inspection report was done a day before he collected the car & report stated rotor required replacement. Buyer said I never highlight to him when the report was given to him. Now he claimed he never read if not will not buy my car. In the first place, he said got 3 stars report good enough.

2. He discovered the rotor worn out after one month & claimed I am a car enthusiast & I should have replaced it when it was due long ago. In the first place I sold the car as what he viewed twice. Again he claimed I did not highlight the rotor.

3. Now ask me pay for the rotor for $1000.

I read the SMS buai tahan, how to reply him?

Before knowing the rotor worn out, I already give him 1K discount.
Knn I also dunno rotor worn out first place. I hope his horn spoil.

Re: Serious question - how to reply a buyer.

there might be a sense of moral obligation if he was not aware of the issue.

however, he had the report. there was full disclosure. if he had an issue, he should have negotiated before making payment.

I use Infratint, then realised white ants don't like me. Haven't sms Sherman yet.

On a serious note, I would call him up and tell him off but in a polite manner, that the report is there and that there was no misrepresentation.

On an even more serious note, if he is going to "stomp" you or question your intergrity publicly (e.g. forum), then warn him that that's defamatory and you can pursue legal action if he continues.

Ya he drove off with the report. If don't read then why asked me go inspect. Without report I also dunno rotor worn out. Then after one month said I never mentioned to him about rotor when he said as long 3 stars report he ok. The report is 3 stars.

The story goes like this.. "One man went to the match making agent to choose a girl to be his wife. The man think that the girl is sexy so didn't bothered too much. After one month, he came back & claim to the agency that he found out that the girl is not a virgin... demanding that he shld be informed in the first place.." hahaha

But this one no 3-star report, so seller's fault.

Re: Serious question - how to reply a buyer.

In my opinion after transfer of ownership, onus lies with buyer not seller.

It is the prospective buyer's responsibility to have the car inspected by a professional and knowledgeable workshop.

The seller on the other hand should discharge as much information as he/she knows about the performance, periodic maintenance, service history etc to the seller. This can be a bit of a grey area.

As with any sales, I'm a firm believer of buyer's doing their homework and seller releasing factual history of the car to his/her knowledge. This is a two hands to clap policy which is rarely the case.

If an inspection was carried out and a full report is provided to the seller, it is assumed the seller has read the report, agrees with the condition of the car and carries on with the transaction. Meaning he/she is well aware of the condition of the car, in this case, worn rotors, prior continuing with the purchase.

Mid this year I sold both my E46 and E92 M3.

Upon inspection Buyer discovered my E46 M3 had a leaking SMG Feedpipe and High Pressured Powersteering hose. I had both feedpipe ($30+aud) and HPPH ($600aud) replaced. No changes made to agreed selling price. Buyer is satisfied with the repair and continues with the purchase.

Hypothetically speaking had the buyer returned to me a month or a year later and said either pipes leaked again, it would not be possible for me to honour any repairs. For me to do that would be to somewhat provide a free factory warranty to any buyers. This is 2nd hand car sales and buyers should be aware of any inherent wear and tear or manufacturing defects pertaining to a vehicle.

Simply put, I don't see any excuses for a recourse when a report is provided to the seller. Especially not 1 month later. He could have done a 12hour endurance race or conquer 99 bends religiously every night.

Had the buyer highlighted the worn rotors upon reading the report prior to the purchase, he could, A) Buyer will replace rotor at own cost upon purchase, B) Seller replace rotors at own cost without changes to agreed selling price, C) Seller lowers agreed selling price to accommodate to worn rotors, D) Buyer refuse to buy. This decision lies entirely between both seller and buyer.
