Accident - charged by TP for Careless Driving

Hi All,

I cant help but feel indignant about this matter.

My car was "brushed" by a taxi on the right rear by his left front (damage is cosmetic., scratches only)
and he makes a police report, claiming damage of 3.8k, and passenger injury of over 20k!

to top it off, TP then hits me with this 6 points and $200 fine for careless driving? c'mon. where is the fairness in all this?

Any good advice would be well appreciated. Legal advice would be even better.

vypez, did you stop after the incident and take photo, then report the incident to insurer? Or sign anything with the taxi driver?

If not, then it's his words against your words.... must fight it out liao.....

(I presume no video evidence exists in this case.)

This type of thing you should have take it seriously. sorry I am not sure about the taxi driver...

to me such thing can be "fake" accident from passenger to a workshop claim specialist, lawyer to doctor.

Not related to your case..

IMHO if a taxi just "brushed" your car & insist call police, the passenger was "acting" to be injured & call ambulance... if not, recommend by the workshop to a doctor from "reputable" hospital, went thru MRI, etc. confirm $20,000. The taxi touch up at $150 but claim lost of income confirm $3,800. in order to win the case, the workshop will need lawyer to sue your fault & you kenna demerit points & fine from TP.

end of day you sure lose the case if you don't fight legal with them. next, the claim will be with you & you kenna insurance renewal up the lorry.

Have you made a police accident report also? When did it happen? Although I doubt medical report would come so soon. Words against words, maybe the passenger got previous injury want to claim also

usually, once TP fine you and award demerit points, you lost already.

I am sure TP would have called you up for investigation. I take it that you were not able to justify your position, hence TP recorded you as guilty.

Another case of if only I have installed that video cam on the front and rear..... lesson learn guys... MTL!

The situation looks ominous Vypez, lawyer to fight a case like this will not come cheap. Perhaps u can provide more detaisl.....

Not possible... there should still be footage of before and after hitting blind spot. A car cannot appear from blind side then stay there after accident.

I will play devil's advocate here.


If the situation is as bad as what TS said..re being fined and penalised in points by TP and coupled with the taxi driver's claims of such huge amounts...TS comes in here feeling only "indignant" and to ask for advice???? I would have become delirious.

I venture to add that any SANE person who recieved such claims and charges would have camped outside his/her lawyer's office the night before to ask what can he/she do about it...

If long ago I know such incident exists... i would have save money open car workshop, study hard be a lawyer & get a doctor gf... nabe too late too.
