Belly belly sure..... Ask ROD... R2D

Re: Throttle issue.

update...
2 vanos solenoid changed... 2 pre cat O2 sensor changed.....vanos intake fault still there, marbles in a can sound still there.....hesitation at moveoff is slightly better. Mechanic says since the head gasket was remove before, he is worried that the resurfacing of the cylinder was overdone.....anyone can help....sigh....wasted money for this fault isolation process.

Throttle issue.

Not sure we get it.

Didn't you go to the unknown workshop with the self-proclaimed 'expert' uncle only because the dealer was paying for the repairs?

Why are you paying out of pocket now, and for a job that's did not resolve the issue you went back to the dealer for?

Re: Throttle issue.

Re: Throttle issue.

Im quite sure if its an transaction made between a business and consumer over a product, lemon law will apply.
the law doesn't care if he makes $ or lose $.

you may wanna see legal recourse or go to a mediation centre first.

Re: Throttle issue.

Lemon law doesn't apply between individuals and consumer transactions...tats wat the dealer is trying to say...consignment...meaning the seller is not a business...which would have made the Lemon law effective otherwise...

smart move over by dealers nowadays.

Re: Throttle issue.

For used car, wear & tear is part of d package. Just go to a BMW specialist.

Re: Throttle issue.

If there is a sales agreement between the dealer and the buyer signed, be it consignment or not, lemon law should cover correct?
cause it still a sales and purchase between the dealer entity and the buyer.

unless the dealer is cunning enough to handle only the paperwork to facilitate the S&P between the two individual.

Common tactics used by car dealers when negotiating with motor cars buyers.
1) Consignment Cars / Consignment Vehicles. This is the most common tactic used by car dealers when they are negotiating with car buyers. This vehicle does not belong to car dealers. It is being consigned by the current owners to sell. They only earn a small commission upon the completion of sale of vehicle. In legal terms, it is correct by using consignment terms, the motor dealers are not bound by lemon law. But if the buyers are taking a bank loan, motor dealers are involved as the balance of the car price is being paid to them as they will be the last legal owners before transferring the legal titles to the new buyers. If car is found to be lemon, both banks/finance co and registered owners could take legal actions against the motor dealers and it is the duty of car dealers to repair/replace or even cash in lieu to the registered owners/banks/finance co.

Re: Throttle issue.

TS, would strongly suggest you sent your car to the ws recommended by those replies earlier. What other suggestions can we give ? Can't expect us to repair your car right.
If the ws mechanics you sent to cannot repair your car properly, do you think we can do a better job just by reading your post and replying?

Re: Throttle issue.

Then you should change marque .... what are you waiting for ?

Set expectation correctly with ownership of BMW. If u have done your homework, u will not land in this situation.

If u own it because of the badge, i would ask u to buy new 1.
